Notary for Affidavits
A written statement of evidence which is sworn under oath before a person authorised to administer affidavits, such as a Notary Public. Affidavits take a similar form to witness statements, but they include a jurat instead of a statement of truth.
They are often used where the deponent or affiant (person giving the Affidavit) is making a statement which he cannot otherwise prove and is therefore willing to “swear” (or affirm) this. If an Affidavit is to be relied upon by a recipient overseas, it is likely that it will need to be sworn before a Notary Public.
Your signature on the Affidavit will be attested by the Notary Public, rendering it to have been properly sworn/affirmed in acceptable format for the foreign recipient. Affidavits may also be sworn before a solicitor however this will only be acceptable if the document is to be used in England & Wales and not for documents to be used abroad.
Sworn Oaths & Notary Attestation
An oath is a solemn and formal declaration or promise, usually made with a sense of personal commitment or legal obligation. It is often taken in front of certain witnesses, such as in legal proceedings, ceremonies, or official settings. An oath can be sworn to uphold a duty, tell the truth, or adhere to a set of principles or laws. A Notary attestation to an Oath allows the document to be relied upon and renders it acceptable to the foreign recipient.
Commissioner of Oaths Notary Public
A Notary is also a Commissioner for Oaths as is a Solicitor, however as above, a Solicitor will only be an acceptable Commissioner of Oath for documents used in England & Wales, and not for documents to be used abroad. What is required of you?
Bring all documents/correspondence relating to the matter including any instructions that it came with from the foreign jurisdiction.
Please do not sign the documents prior to the appointment.
Your ID’s (1x photo ID e.g. passport/driving licence and 1x address ID’s e.g. a utility bill/bank statement (no more than 3 months old). If you cannot present any ID documents, I will probably not be able to proceed with your matter.
Any emails received on this matter should be forwarded to me by email prior to our appointment including any contact details of the foreign recipient.
Please advise in advance if the document is in a foreign language and which one.
